1. Scope

All deliveries from the ONLINE shop of the Technology Museum operated by St museum, operated by Speyerer Veranstaltungs- und Messe GmbH, Am Technik Museum 1, 67346 Speyer (hereinafter: ONLINE Shop) to consumers (as defined in ß13 of the Civil Code) are subject to these Terms and Conditions.

2. Parties

A purchase contract is created with Speyerer Veranstaltungs- und Messe GmbH, Am Technik Museum 1, 67346 Speyer, Commercial Registry Ludwigshafen HRA 63245.

3. Offer and creation of contract

3.1 The offering of products in the online shop is not legally binding, but is rather an invitation to order "while supplies last", if not otherwise stated on the product listing, errors excluded.

3.2 By clicking ìCommit to Purchaseî in the final step of the ordering process, you are making a binding order for the products in your shopping basket. The purchase contract takes effect when we accept your order with an order confirmation e-mail sent immediately after receiving your order.

4. Right of Cancellation

4.1 Consumers (ß13 Civil Code) have a statutory right to cancel their purchase.

You may cancel your contract within 14 days without giving reasons in writing (i.e. letter, fax, email) or, if the goods have been shipped before the deadline, by returning the goods. The period begins upon receipt of this notification in writing, but not before receipt of the goods to the consignee (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also does not fulfil our obligations under Art. 246 ß2 in connection with ß1(1) and (2) of the Preamble to the Civil Code (EGBGB) or our obligations according to ß312e(1)(1) BGB in conjunction with Art. 246 ß3 BGB. Timely submission of the cancellation notice or of the goods is sufficient to meet the cancellation deadline. Notice must be sent to:

Consequences of Cancellation:

In case of an effective cancellation, the mutually received benefits and any accrued benefits (e.g. interest) are to be returned. If you cannot return the product received in whole or in part or only in a deteriorated condition, you  must compensate for the lost value. For the return of products, this does not apply if the damage to the item can be attributed solely to its inspection such as would happen in a brick and mortar retail store. You can also avoid paying for lost damage by not treating the goods as your property and not doing anything to reduce its value. Transportable items are to be returned at our risk. You have to bear the cost of return if the delivered goods match what was ordered and if the price of the item to be returned does not exceed Ä40 or for higher-priced items if, at the time of cancellation, you have not paid in whole or in part as agreed. Otherwise the return is free for you. Items not suitable for parcel post will be picked up. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you when you send your cancellation or the goods; for us it begins upon their receipt.

Exclusions to the right of cancellation
The right does not apply to mail-order contracts for the delivery of audio or video recordings or software if the delivered data devices have been unsealed by you.

5. Prices and shipping costs

5.3 The prices quoted on the product pages include VAT and other price components.

5.2 In addition to the prices listed, we charge for delivery within Germany. The costs will vary by product weight and are clearly indicated on the product pages, the shopping cart system and on the order page. During your purchase in the ONLINE Shop, you can always use the "Shipping Calculator" to calculate potential shipping costs for the items currently in your shopping basket.

6. Delivery

Delivery is usually made within 3 business days. If other delivery times apply, we will reference these on the relevant product page.

7. Payment

7.1 Payment may be made in advance, direct debit, bank transfer or credit card.

7.2 If payment is to be made in advance, we will provide our bank details in the order and deliver the goods after payment.

7.3 You may only apply offsets to your payment if such right has been granted by court order or has been  acknowledged by us in writing.

7.4 You may only withhold payment for claims from the same contractual relationship.

8. Retention of title

Until full payment, the goods remain our property.

9. Warranty

The warranty is subject to the statutory provisions. For all flaws occurring during the statutory warranty period of two years after delivery, you have the legal right to remedy (at your option: repair or replacement), and, if the statutory requirements are met, the legal right to a price reduction, cancellation of contract and damages. You must give us a total of two attempts to remediate the flaw. If the costs to implement your desired form of remediation are disproportionate, your claim is limited to the other form of remedy available.
